Terms of Carriage

“Company” is Smart Minibus Hire Ltd

“Hirer” is person or company who made the booking

A, These conditions apply for if a contract has been made verbally or in writing.

The Hirer contracts with the company upon behalf of the hirer and as agent for all passengers travelling upon the vehicle. The hirer expressly warrants that he has the full authority of all passengers to enter into this contract upon their behalf and to accept these conditions of hire.

The hirer shall indemnify the company against any loss, claim, damage, award or settlement which may be made against the company in excess of the exclusions and limitations of liability contained in the conditions of hire asa a consequence of any lack of authority upon the part of the hirer to enter into this contract.

Quotations

B, Quotes include parking charges up to an agreed time. VAT is charged at 0% on all vehicles with more than 8 passenger seats. Quotations are valid for an agreed period.

Use of Vehicle

C, Unless confirmed in writing by the company, the vehicle should not be assumed to remain at any point between the outward and return journeys nor to remain available for the hirers incidental use when parked at such points.

Drivers Hours and Rest Period

D, The hours agreed with the company for the operation of any hire must be observed (other than in case of serious emergency or diversion) so that current regulations governing drivers hours and rest periods may be compiled with. The company reserves the right to curtail or otherwise alter any hire which does not comply with the relevant regulations.

Seating Capacity

E, The hirer must not load any vehicle beyond the number of passengers which it is legally permitted to carry.

Conveyance of Animals

F, On a private hire, no animal (other than guide dogs and hearing dogs notified notified to the company in advance)  may be carried on any vehicle without prior agreement from the company.

Confirmation

G, Written confirmation by the company is the only basis for the acceptance of a hiring or for booking alterations.

Payment

H, Deposit or full payment must be made to secure booking. If the deposit is not paid by the deposit due date then you may lose your booking.

Cancellation 

I, Deposits are non refundable as the vehicle has been reserved for you and potentially refused to new bookings. Full amount due 7 days before travel date. 

1, If cancelled with less than 7 days notice no refund will be made of full payment.

2, If cancelled with more than 14 days notice than total amount minus 50% deposit will be refunded.

Cancellation by the Company

J, In the event of any emergency, riot, civil commotion, strike, restraint of labour or on the happening of any event over which the company has no control (including adverse weather and road conditions) or in the event of the hirer taking any action to vary agreed conditions unilaterally , the company may, by returning all the money paid and without further or other liability, cancel the contract.

Route and Time Variations

K, Should a vehicle be detained by a hirer, or taken on a longer journey than that contracted for. The company reserves the right to make an additional charge. During the hiring, the driver must be the judge of the reasonableness of any requester a change of route and time. In any event the vehicle will depart at the agreed time and the company will not be liable for for any loss or injury sustained by a passenger failing to join the vehicle at the appointed time.

Vehicles to be provided

L, The company reserves the right to substitute other vehicles (including those of other operators) for all or part of the journey. 

If a vehicle is fitted with a toilet you must specify you would like use of this service which will be charged accordingly .

Breakdowns and Delays

L, The vehicles are meticulously maintained to a very high standard to avoid mechanical issues.

In the event of a breakdown the company will try and arrange alternative transport within 1 hour. If this is not possible then you are free to arrange transport and the company will refund the cost of that journey you booked with the company (one way).

If the company has advised on travel time it does so in good faith. It does not guarantee a time thus will not be held responsible for any loss or inconvenience.
